EULA - End User License Agreement

LICENSE AND WARRANTY AGREEMENT:
This document is a legal agreement between you (an individual or business) and Interactive Systems Inc. Use of this software indicates your acceptance of the terms of this agreement.

LICENSE:
This software is protected by both United States copyright law and international treaty provisions. This software is not shareware or freeware and may not be distributed by bulletin boards or other forms that violate Interactive Systems Inc.'s copyrights. Duplication of this software is allowed for the sole purpose of backing up the software and protecting your investment from loss.

LIMITED WARRANTY:
Interactive Systems Inc. warrants the media on which the program is furnished to be free from defects in materials and workmanship under normal use for a period of thirty (30) days from the date of delivery to you. In the event of notification within the warranty period of defects in the material or workmanship, Interactive Systems Inc. will exchange the media. Interactive Systems Inc. further warrants that the software as delivered conforms substantially with any Interactive Systems Inc. advertised claims at the date of sale. In the event of a notification within the warranty period of failure to meet any Interactive Systems Inc. advertised claims at the date of the sale, you may return the program and all associated materials in good condition to the place of purchase for a refund of the purchase price. Refunds do not include shipping, handling, COD charges and the like. The sole remedy for breach of this warranty is limited to replacement or refund, and shall not encompass any other damages, including but not limited to loss of profit, incidental, consequential, or other claims.

LIMITATIONS OF REMEDIES:
Interactive Systems Inc. specifically disclaims all other warranties, expressed or implied, including but not limited to implied warranties of merchantability, non-infringement of third party rights, and fitness for a particular purpose. In no event shall Interactive Systems Inc. or its suppliers, if any, be liable for any loss of profit or any other damages, including but not limited to incidental, consequential, or other damages.

COMPLETE AGREEMENT:
Having read this Agreement, you agree that no contrary or inconsistent statement, oral or written, has been made by any person, and that this is the complete and exclusive statement of the terms and conditions of the Agreement between us, and any prior proposal or statement, whether written or oral, is superseded. In the event of any dispute regarding the terms and conditions of this agreement, you agree that the laws of the State of Ohio will govern the interpretation of the Agreement.

U.S. GOVERNMENT RESTRICTED RIGHTS:
The software and documentation are provided with restricted rights. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software -- Restricted Rights at 48 CFR 52.227-19, as applicable.
